- SSSAK-ARBITRATION EMERGENCY MEETING.
REF: RESOLUTION OF TODAY MEETING DISREGARDING THE PURPORTED ELECTION.
The Arbitration Board of South Sudan Students Association in Kenya (SSSAK) fully welcome the impeachment of Ayuel Taupiny Malek and Tom Gatdel Malou on grounds prescribed in the Council resolution which took place in Nakuru. The Arbitration Board through its representative in form of the Board Chairman Justice Ajang Dut Ajang welcome the resolution of the council which installed an Interim Leadership to act in office for six months awaiting an electoral process; the
participation of the union judiciary which acts as a-doc cartilage to a legal proceeding in the union is legitimate and shouldn’t be question-based on political interference rather than a bidding boundary among the students and the SSSAK organs.
The board reached out to parties cited in the cases for ripostes and made a decision accordingly. The board made the independent decisions under the law of the union and the judgment details shall be avail to the public in two weeks.
The board convened a virtual meeting and voted to welcome the resolution with a parameter voting confidence of 99%.
The board decided as follows:
1. That the installation of Kuei Mawien as the interim chairperson of SSSAK is constitutional
since it meets the constitutional threshold.
2. That the electoral process shall go on as planned by the council resolution in Nakuru under the Interim leadership.
3. That the board welcomes the impeachment of the two as passed by the Council Leadership.The impeachment case will be communicated as soon as the board receive the materials
used in the meeting of 30th of January.
4. The board will convene another virtual meeting on the 8th of February 2021 to further deliberate on any other AOBs.
The board made a further directive as follows:
1. The general elections of the Union to be done within the re-up period as confirmed by the council resolution in Nakuru.
2. That Ayuel and Tom are restrained from involvement in the process of
election and the conduct of interim leadership.
3. The electoral commission is directed to verify data before the election date to address the issue of credibility, transparency, and verifiability according to interim leadership guidelines.
4. That the arbitration board decision is final and not subject to review according to the union constitution.
5. That the purported electoral process being organized by Obur Edward and a few politicized electoral commissioners is unconstitutional, repulsive, barbarous, and can amount to punitive measures if the perpetrators of such illegal gathering purported to take place tomorrow are not going to heed the call of the union constituted organs.
